NAILINFINITY CUSTOMER LOYALTY PROGRAM TERMS
1. Terms used in the Terms
1.1. FASHION infinity – SIA "FASHION infinity", reg. No. 50103822471.
1.2. Customer loyalty program – customer loyalty program "NAILINFINITY" customer card implemented by FASHION infinity.
1.3. NAILINFINITY – the customer loyalty card issued to the FASHION infinity customer, which ensures participation in the "NAILINFINITY" loyalty program. When making purchases at FASHION infinity sales points and on the website, NAILINFINITY owners can accumulate points and receive discounts, as well as other benefits, in accordance with the terms of the Customer Loyalty Program valid at the relevant time.
1.4. Owners of NAILINFINITY - persons who have valid cards of the Customer Loyalty Program "NAILINFINITY" and who can use the privileges granted by NAILINFINITY.
1.5. Account – NAILINFINITY Customer Loyalty Program participant account with information about him created in the FASHION infinity customer database.
1.6. Cooperation partner – a FASHION infinity partner that cooperates with FASHION infinity as part of the loyalty program and offers various advantages to the members of the Customer loyalty program. The list of cooperation partners and benefits may be published on the website www.nailinfinity.eu or in advertising materials.
1.7. Loyalty program questionnaire – a customer questionnaire that must be filled in to apply for the Customer Loyalty Program.
1.8. FASHION infinity website – FASHION infinity website located at www.nailinfinity.eu .
2. General regulations
2.1. These terms define the terms of use and operation of the FASHION infinity Customer Loyalty Program "NAILINFINITY".
2.2. NAILINFINITY is a card that accumulates points, discounts and levels. The operating principle of NAILINFINITY is as follows: when shopping at any FASHION infinity store or website for at least 0.01 cents, you accumulate % points from the purchase amount, which forms your level. The higher the amount spent, the higher the accumulation level is awarded. Accumulation of point levels takes place according to the following system:
Level 1 or starting level. You received 1% points savings from the purchase amount. The range of savings points for this level is from 0 to up to 1000 EUR per amount spent.
Level 2. 3% points accumulation from the purchase amount. The range of savings points for this level is from 1001 to 2000 EUR per amount spent.
Level 3. 5% points accumulation from the purchase amount. The range of savings points for this level is from 2,001 to up to 3,000 EUR per amount spent.
Level 4. 7% points savings from the purchase amount. The range of savings points for this level starts from 3001 EUR per amount spent.
The amount of 1 EUR corresponds to the amount of 1 point in accordance with the principles of accumulation of points stipulated in these regulations.
On the last day of each month, the data system register performs the entire analysis of NAILINFINITY, and if in the previous month the member of the NAILINFINITY Loyalty Program has not accumulated points in the amount of 100 (one hundred) points from the purchase amount, the NAILINFINITY level is reduced by one level by the amount of the initial level point range, valid until the next level is reached.
The owner of NAILINFINITY, at his discretion, can use the savings in one of the next purchases to pay for the selected products, but not more than 80% of the value of the product or services, 20% is paid in the option chosen by the customer (in cash, bank card or by transfer) . If you do not use the savings on the next shopping trip, it will remain in NAILINFINITY and will be added to the points accumulated in the future. In this way, NAILINFINITY can accumulate an unlimited number of points, which the owner of NAILINFINITY can use whenever he wants. After the selected point is used, it is removed from the accumulated amount of points, and the accumulation continues from the existing balance. The validity period of the accumulated points is 6 months, after the validity period the unspent accumulation of points is automatically deleted.
2.3. As part of the customer loyalty program, NAILINFINITY owners may also be granted other benefits, about which NAILINFINITY owners who have agreed to receive news may be notified separately. Personalized offers may be offered to NAILINFINITY owners who have agreed to prepare and receive the respective personalized offers.
2.4. The advantages and discounts that FASHION infinity provides to the owner of NAILINFINITY within the Customer Loyalty Program are determined by FASHION infinity and are subject to change. The current offer of advantages and discounts that the members of the Customer Loyalty Program can receive within the Customer Loyalty Program is available in FASHION infinity advertising materials, on the FASHION infinity website on the Internet or in notifications to NAILINFINITY owners who have agreed to receive relevant information in the Loyalty Program questionnaire.
2.5. The advantages and discounts that the owner of NAILINFINITY can receive at FASHION infinity or at Cooperation partners are not cumulative with other advantages and discounts determined by FASHION infinity, for example, with sales discounts, coupons, wholesale price. Discounts are not cumulative, only one type of discount is applied to each purchase, except in cases where it is specifically provided for.
2.6. The discounts, accumulation of points and benefits provided by the customer loyalty program do not apply to: (1) services provided by third parties and goods sold; (2) gift cards; (3) for goods (including services) indicated at the time of purchase in the "Loyalty Card" section on the website www.nailinfinity.eu or in the FASHION infinity store, which do not apply to discounts and benefits of the Customer Loyalty Program.
2.7. These terms constitute the agreement concluded between FASHION infinity and NAILINFINITY cardholders regarding the operation of the Customer Loyalty Program and the NAILINFINITY owner's participation in the Customer Loyalty Program. These terms (agreement) determine the obligations, rights and responsibilities of the participants of the Customer Loyalty Program and FASHION infinity regarding participation in the Customer Loyalty Program, issuance, circulation and use of NAILINFINITY.
2.8. These terms are binding on all persons who use NAILINFINITY or receive discounts, benefits within the framework of the Customer Loyalty Program.
3. Receiving, activating and using NAILINFINITY
3.1. NAILINFINITY can be used by the owner of NAILINFINITY during the duration of the Customer Loyalty Program.
3.2. NAILINFINITY can be received by any natural person who has reached the age of 18 at the time of filling out the Loyalty Program questionnaire. A legal person, as well as persons who make purchases for the purpose of economic activity or commercial activity, cannot participate in the Customer Loyalty Program.
3.3. FASHION infinity determines the fee for NAILINFINITY according to the price list in force at the relevant time, which amounts to 5.00 (five) EUR as of 01.01.2021. The NAILINFINITY purchase fee is non-refundable.
3.4. In order to purchase NAILINFINITY, you need to fill out and sign the Loyalty Program form approved by FASHION infinity, which can be obtained at FASHION infinity stores or on the website under "Loyalty card"
3.5. To start participating in the Customer Loyalty Program, after purchasing NAILINFINITY, you need to activate NAILINFINITY in the FASHION infinity data system, which takes place within 2 working days. FASHION infinity has the right to unilaterally change the entry time according to the number of card applications. NAILINFINITY is usable and the owner of NAILINFINITY can start participating in the Customer Loyalty Program after NAILINFINITY has been activated by FASHION infinity.
3.6. By activating and starting to use (using) NAILINFINITY, the owner of NAILINFINITY confirms that he has read these terms, understands them and agrees to abide by them without limitations and conditions.
3.7. The owner of NAILINFINITY is responsible for using NAILINFINITY in accordance with the provisions of these Terms and applicable laws.
3.8. The owner of NAILINFINITY is responsible for the storage and preservation of NAILINFINITY, he is obliged to carefully use and store the NAILINFINITY card.
3.9. The owner of NAILINFINITY is obliged to provide only true and up-to-date information in the Loyalty Program questionnaire.
3.10. The owner of NAILINFINITY is obliged to present NAILINFINITY before making a purchase at FASHION infinity sales points, as well as before receiving benefits from Cooperation Partners. FASHION infinity reserves the right not to apply the discounts, benefits and accumulation of points provided by the Customer Loyalty Program if no

Such rights may be limited if the owner of NAILINFINITY has not provided sufficient identifying information when completing the Loyalty Program questionnaire or later.
3.12. The owner of NAILINFINITY cannot transfer the accumulated points and benefits to another person or another NAILINFINITY card, nor can he combine the accumulated points and benefits of several NAILINFINITY.
3.13. For issuing a new NAILINFINITY, a fee is applied in accordance with 3.3.
3.14. NAILINFINITY discount, points accumulation or advantage cannot be granted after the cashier's check is issued retroactively.
3.15. The owner of NAILINFINITY can save NAILINFINITY under his FASHION infinity website account and receive all the benefits of NAILINFINITY. Only one NAILINFINITY can be assigned per account.
3.16. The NAILINFINITY user has the opportunity to use the accumulated points, receiving a discount, as per clause 2.2. for the principle of operation, if a purchase is made with accumulated points, then the purchase points are not assigned. Savings cannot be received in cash, service or product. The savings can only be used in FASHION infinity stores, on the website www.nailinfinitu.eu or at cooperation partners.
4. Termination and reactivation of the card
4.1. If NAILINFINITY has not been used for 6 (six) months, FASHION infinity deactivates NAILINFINITY. Use of NAILINFINITY within the meaning of this paragraph is the making of purchases by presenting and recording NAILINFINITY in the purchase. Accessing the NAILINFINITY user account on FASHION infinity's website, purchasing purchases and services from Cooperation Partners and communicating with FASHION infinity regarding Customer Loyalty Card issues are not considered card use.
4.2. At least one month before NAILINFINITY's deactivation, FASHION infinity sends the NAILINFINITY owner information about deactivating the card, if the NAILINFINITY owner has previously agreed to receive the information and provided a valid phone number or e-mail.
4.3. A deactivated NAILINFINITY can no longer be used to participate in the Customer Loyalty Program (including accumulating points, receiving discounts or benefits).
4.4. If NAILINFINITY is deactivated, the owner of NAILINFINITY can ask for activation by contacting FASHION infinity sales points. FASHION infinity activates NAILINFINITY as quickly as possible, but no longer than 2 (two) working days.
4.5. Deactivated NAILINFINITY can be used after its activation. In case of activation of NAILINFINITY, the discounts and advantages accumulated before deactivation are not saved, as well as previously accumulated NAILINFINITY points accumulation levels and accumulated points are not saved.
4.6. If a deactivated NAILINFINITY is not activated within 6 (six) months after its deactivation, FASHION infinity terminates the relevant NAILINFINITY's membership in the Customer Loyalty Program, the NAILINFINITY becomes invalid and the NAILINFINITY owner's participation in the Customer Loyalty Program is terminated by deleting the personal data provided by the NAILINFINITY owner from the database.
4.7. If NAILINFINITY is deactivated (it becomes invalid), its activation is not possible, but the owner of NAILINFINITY can purchase a new NAILINFINITY and re-become a member of the Customer Loyalty Program by applying 3.3. the prescribed fee,
4.8. FASHION infinity can block NAILINFINITY and issue a new one instead, if it is necessary due to technical, security or Customer loyalty program changes, as well as in cases where NAILINFINITY has become technically unusable through no fault of the owner of NAILINFINITY.
5. FASHION infinity website and operation
5.1. By activating NAILINFINITY, the owner of NAILINFINITY can add a NAILINFINITY card to his account on the FASHION infinity website, if one has been created, if not, the NAILINFINITY member is entitled to do it at the address www.nailinfinity.eu
5.2. The NAILINFINITY owner can access their NAILINFINITY user account on the FASHION infinity website. On the NAILINFINITY website of FASHION infinity, the owner can view information about his participation in the Customer Loyalty Program, correct and update the information.
5.3. FASHION infinity may provide NAILINFINITY owner notification and access to NAILINFINITY user account through FASHION infinity mobile apps. Provision and maintenance of apps for mobile platforms (e.g. Android, iOS) is not a mandatory obligation of FASHION infinity as part of the Customer Loyalty Program.
5.4. The owner of NAILINFINITY is responsible for keeping the username and password assigned to him, their transfer to any third party is prohibited.
5.5. Changes made with the username and password assigned to the NAILINFINITY owner in the relevant NAILINFINITY user account (both on the FASHION infinity website and mobile apps) are binding on NAILINFINITY.
5.6. It is forbidden to interfere with the normal operation of the FASHION infinity website or mobile app, including with the aim of correcting information in the database, obtaining unjustified points, discounts or benefits, accessing other people's data, unauthorized access to information systems.
5.7. The use of the FASHION infinity website or the FASHION infinity mobile app may be subject to additional terms.
5.8. The owner of NAILINFINITY is entitled to use NAILINFINITY FASHION on the infinity website and accumulate points, discounts or benefits.
6. Personal data protection and privacy
6.1. The data controller is FASHION infinity – SIA "FASHION infinity", reg. No. 50103822471, contact information for personal data protection issues: Riga, Brīvības 174a, LV-1012, info@nailinfinity.eu, +371 29343413.
6.2. FASHION infinity takes care to protect the privacy of the owners of NAILINFINITY, regarding the processing of personal data in accordance with the General Data Protection Regulation no. 2016/679 and applicable legislation. FASHION infinity takes reasonably necessary measures for the security of personal data to protect them against theft, loss, misuse, as well as against unauthorized access, disclosure, modification and damage.
6.3. FASHION infinity processes the personal data of the members of the Customer Loyalty Program in different ways for several purposes, depending on whether it is a registered user, a non-registered user and whether there has been an application to receive news and commercial notices.
6.4. FASHION infinity does not process personal data provided by the owner of NAILINFINITY without a legal basis. FASHION infinity is obliged to disclose personal data to state and local government officials in cases specified by law or when required by law.
6.5. Personal data related to the sending of commercial communications is processed only by FASHION infinity and FASHION infinity's cooperation partners, which provide IT structures, e-mail and text messaging platforms. The minimum required amount of personal data is transferred to cooperation partners, and there are written regulations that provide for the protection of personal data.
6.6. FASHION infinity may process personal data in an aggregated form for statistical purposes in order to analyze and improve the services and products provided. FASHION infinity collects and stores information about the purchase history of the Customer Loyalty Program participant with the aim of improving the services and products provided, based on FASHION infinity's legitimate interest in collecting information about the quality of the offered services and products, as well as with the aim of ensuring the operation of the Customer Loyalty Program.
6.7. FASHION infinity is entitled to process the personal data of the participants of the Customer Loyalty Program, as far as it is necessary for the fulfillment of these rules, for the maintenance and operation of the Customer Loyalty Program system, for ensuring the legitimate interest of FASHION infinity and for fulfilling the rules and requirements of the law and supervisory and control authorities binding on FASHION infinity.
6.8. According to the current legislation, the Customer Loyalty Program participant has the following rights:
6.8.1. request access to your personal data;
6.8.2. request correction or deletion of your personal data to the extent possible;
6.8.3. request restriction or objection to the processing of your personal data;
6.8.4. request the transfer of your personal data to the extent possible;
6.8.5. withdraw your consent to the processing of personal data at any time;
6.8.6. submit a complaint to the national data protection authority for natural persons (in the Republic of Latvia - Data State Inspectorate);
6.8.7. contact FASHION infinity and get additional information about the processing of your personal data.
6.9. By activating NAILINFINITY and starting to use it on the FASHION infinity website and/or stores, the personal data of the owner of NAILINFINITY is used to enter into an agreement with FASHION infinity regarding participation in the Customer Loyalty Program, account creation, maintenance and participation in the Customer Loyalty Program.
6.10. FASHION infinity processes the personal data of the members of the Customer Loyalty Program for the following purposes:
6.10.1. for participant identification and administration of registrations (based on fulfillment of contractual obligations, consent);
6.10.2. For the implementation of the customer loyalty program and the administration of membership (based on the fulfillment of contractual obligations);
6.10.3. To inform the participants of the Customer Loyalty Program about the activities of the Customer Loyalty Program, FASHION infinity and the offers of Cooperation Partners (based on the fulfillment of contractual obligations, consent);
6.10.4. for the preparation and presentation of the most relevant (including personalized) offers and benefits (based on the fulfillment of contractual obligations);
6.10.5. to send direct marketing, commercial communications (based on consent);
6.10.6. for the creation of sales statistics and the market (based on the fulfillment of contractual obligations, the legitimate interest of FASHION infinity).
6.11. By activating NAILINFINITY, the owner of NAILINFINITY confirms that he is aware that the entered data is processed to create and maintain the Account and ensure participation in the Customer Loyalty Program, including to create and save the customer's wish list, purchase history and send information related to the Customer Loyalty Program .
6.12. FASHION infinity processes the personal data of a member of the Customer Loyalty Program in order to send him relevant and appropriate commercial communications, if the relevant consent has been received.
6.13. FASHION infinity performs various types of profiling, collecting the information provided by the Customer Loyalty Program member and obtained during the use of the NAILINFINITY card, in order to analyze what services and products might be of interest to the Customer Loyalty Program member, and to send a commercial message of appropriate content. The automatic data processing (profiling) will take place mainly taking into account the date of the Customer's last purchase, the amount of the purchase, the average amount of purchases, as well as the locations of the stores used, and based on these parameters, the information and offers for sending can be selected by creating and sending a commercial announcement with appropriate content.
6.14. Informing the members of the Customer Loyalty Program about the offers of the Customer Loyalty Program, FASHION infinity and Cooperation partners is carried out according to the Loyalty Program questionnaire.
6.15. FASHION infinity collects personal data provided during registration in the Customer Loyalty Program using the Account, communicating with FASHION infinity via NAILINFINITY, FASHION infinity website or mobile apps.
6.16. The Loyalty Program questionnaire, audit records of activities in the Account (on the FASHION infinity website and mobile app), as well as communication with the owner of NAILINFINITY, are kept as proof of participation in the Customer Loyalty Program and its conditions. FASHION infinity stores this information based on the legitimate interest to protect its rights and interests in the event of a dispute; in order to fulfill the obligation imposed by law to store information about the commercial activity performed, as well as to comply with the conditions of the Customer Loyalty Program with the specific owner of NAILINFINITY.
6.17. Personal data is processed for the purpose of commercial communications until the consent to receive commercial communications is withdrawn or, in certain cases, until the need to retain evidence of the consent received ceases.
6.18. FASHION infinity stops sending commercial communications as soon as the withdrawal of consent is processed. The processing of the withdrawal of consent depends on the technological capabilities to fulfill the request, which may take up to five days.
6.19. The personal data of the participants of the Customer Loyalty Program is processed until the data retention period specified in the legislation of the Republic of Latvia expires, until the participation in the Customer Loyalty Program is terminated, or until the statute of limitations for filing a claim in court, whichever comes later.
6.20. After the intention to save the data is lost (the data storage period has expired), the provided personal data is immediately deleted or made unidentifiable.
6.21. For the processing of personal data of members of the customer loyalty program, FASHION infinity can issue a privacy policy, which is published on the website of FASHION infinity and determines the procedure for processing personal data.
7. Other provisions
7.1. If the owner of NAILINFINITY has indicated several possible communication channels, FASHION infinity may choose which communication channel to use to send intended notices to the ZKK owner.
7.2. The owner of NAILINFINITY is obliged to immediately update any information, including his personal data, to notify FASHION infinity if the information specified in the Loyalty Program questionnaire or in the Customer Loyalty Program participant database has changed, become outdated or is incorrect.
7.3. In cases where money is refunded to the owner of NAILINFINITY for a product purchased using discounts or benefits of the Customer Loyalty Program, the money actually paid for the product is refunded to the owner of NAILINFINITY and the accumulated points for the returned product are canceled.
7.4. Benefits and discounts are not given in cash to the member of the Customer Loyalty Program.
7.5. FASHION infinity and Cooperation partners have the right not to grant NAILINFINITY discounts or benefits to NAILINFINITY owners if it is found that NAILINFINITY is being used in violation of these rules and to immediately deactivate the issued NAILINFINITY and delete all granted discounts, points and benefits.
7.6. If the owner of NAILINFINITY believes that FASHION infinity has not made an accurate calculation of discount savings or benefits, then a submission must be submitted together with the purchase receipt to check the possible error at any FASHION infinity point of sale. Such an application must be submitted no later than within 1 (one) month from the moment of making the purchase. If FASHION infinity determines that an error has occurred in the data accounting system, then, depending on the request, it grants the intended discount and/or advantage to the owner of NAILINFINITY.
7.7. Any claims related to the Customer Loyalty Program and NAILINFINITY shall be submitted by the owner of NAILINFINITY to FASHION infinity within 1 (one) month after establishing the cause of the claims, but no later than within 3 (three) months.
8. Intellectual property rights
8.1. The design of NAILINFINITY, as well as the information displayed on NAILINFINITY, is determined by FASHION infinity. The design and shape of NAILINFINITY FASHION infinity can be changed at any time.
8.2. All information and content related to the Customer Loyalty Program, NAILINFINITY and FASHION infinity, including but not limited to trademarks, logos, service marks, text, graphic marks, button icons, images, sound recordings, data compilations and software, the compilation thereof and layout, is the property of FASHION infinity, FASHION infinity group companies, partners or licensors and is protected by the laws of the Republic of Latvia and other international laws relating to the protection of intellectual property, including laws governing the use of copyright and trademarks. Without express written permission, the use of trademarks owned by FASHION infinity in any way, for any purpose, is not permitted.
8.3. Copying (reproduction) of NAILINFINITY and making identical or similar tools of NAILINFINITY loyalty programs is prohibited. Any mechanical, electronic or other modification of NAILINFINITY or the information contained therein is prohibited.
9. Final provisions
9.1. FASHION infinity has the right to cancel and/or change these terms at any time by announcing it on the FASHION infinity website or FASHION infinity sales points, or by sending information to the means of communication specified by the owner of NAILINFINITY (e-mail and/or phone). Any changes to these Terms will be effective immediately upon posting. Owners of NAILINFINITY agree that by continuing to use NAILINFINITY after such changes are made, the owner of NAILINFINITY hereby acknowledges its acceptance of all changes.
9.2. FASHION infinity reserves the right to cancel or revoke any rights granted by these Terms. NAILINFINITY owners must comply with such revocation or change from the time they are made, including, if necessary, ceasing use of NAILINFINITY and membership in the Customer Loyalty Program.
9.3. FASHION infinity has the right to terminate or change the Customer Loyalty Program at any time, without continuing the obligations of the previous Customer Loyalty Program. In such a case, the owners of NAILINFINITY have no right to demand the realization of the points or advantages accumulated within the Customer Loyalty Program after the termination of the Customer Loyalty Program, as FASHION infinity also bears no responsibility for possible losses or damages of any kind that may arise from the termination of the Customer Loyalty Program.
9.4. The owner of NAILINFINITY has the right to terminate the operation of his NAILINFINITY and his participation in the Customer Loyalty Program at any time by submitting a signed and dated application at any FASHION infinity point of sale or on the FASHION infinity website.
9.5. FASHION infinity has the unilateral right to terminate the NAILINFINITY owner's participation in the Customer Loyalty Program and/or block NAILINFINITY if these terms are violated or the Customer Loyalty Program is terminated.
9.6. If any of the clauses of these terms are unenforceable or invalid within the framework of applicable laws, or are declared unenforceable or invalid by a court decision, this does not affect the validity or applicability of these terms as a whole, but instead these terms must be amended to the extent possible in accordance with applicable laws so that they fully reflect the original design of the Customer Loyalty Program, in accordance with the original wording of the rules.
9.7. FASHION infinity is not responsible for the quality and safety of the services provided by the Cooperation Partners and the goods sold, the accuracy of the information provided by the Cooperation Partners and the correctness of the discounts and advantages applied by the Cooperation Partners.
9.8. FASHION infinity is not responsible for indirect losses and lost profits caused to the owner of NAILINFINITY, as well as losses that may occur due to the deactivation, termination, damage or loss of NAILINFINITY. The parties shall not be liable in any way (whether in contract, negligence or otherwise) for any interruption or error arising from the operation of the Customer Loyalty Program.
9.9. FASHION infinity shall not be liable for any delay in performance or failure to perform or other failure to perform due to circumstances and obstacles beyond its reasonable control, including but not limited to strikes, government orders, acts of war or national emergency, terrorist threats or acts of terrorism, environmental or climate anomalies, non-performance by third parties, disruptions in the Internet connection, as well as failure of computer equipment and software.
9.10. Any disputes between the owner of NAILINFINITY and FASHION infinity shall be resolved through negotiations. If it is not possible to solve them in this way, then they are solved in the court of the Republic of Latvia. The laws of the Republic of Latvia apply to the mutual relations between the parties and the Customer Loyalty Program.
