Rules on the exercise of the right of withdrawal

1. Right of withdrawal:
2. You have the right to withdraw from this contract within 14 (fourteen) days, stating the reason.
   2. The exercise of the right of withdrawal will expire after 14 days from the day on which you have obtained or a third party other than the carrier and whom you have indicated has obtained possession of the goods.
   3. In order to exercise the right of withdrawal, you must inform us SIA "NAIL infinity", legal address Brīvības 174a-8, Rīga, LV-1012 about the decision to withdraw from this contract and fill out a withdrawal application
   4. In order for the deadline for the right of withdrawal to be respected, it is enough if you send your notification about exercising the right of withdrawal before the expiry of the right of withdrawal and the goods must also be delivered to Brīvības Street 174a-8 before the deadline.
3. Consequences of refusal:
4. If you cancel this contract, we will refund you all payments received from you for the product purchased, no later than 14 working days from the day the goods are received, inspected and the cancellation request is accepted.
   In any case, you will not be charged for any such refund, except where the value of the item has been lost and the seller and the buyer agree otherwise.
   6. You must hand over the goods in person or by courier to the office of www.nailinfinity.eu at Brīvības 174a-8, Riga, without undue delay and in any case no later than within 14 days since you have received the goods and have communicated your decision to withdraw from this contract. The deadline will be met if you send the goods back to the office address, Brīvības 174a-8, Riga, before the 14-day deadline expires. Please note that SIA NAIL infinity has the right to record possible visual damage of the product, as well as the contents of the package, at the time of receiving the goods sent by mail. In cases where, when sending goods to the office of SIA NAIL infinity using courier, SIA NAIL infinity detects damage to the goods or non-compliance of the goods with the visual condition and assembly at the time of receiving the goods, you will be informed. We recommend delivering the goods in person, in Riga, Brīvības 174a-8.
   7. You will have to cover all the costs associated with returning the goods, i.e. customs fees, which may arise if the goods are returned outside the economic zone of the European Union, additional costs may be incurred (transport + customs clearance)
   8. You are only responsible for the decrease in the value of the goods, if the goods have been used for other purposes than to establish the nature, characteristics and operation of these goods.
   9. During the period of exercising the right of refusal, you have the right to use the product as much as it is necessary to check the nature, characteristics and operation of the product - to the same extent as you could do before purchasing the product in a regular store. By using the right of withdrawal, you are responsible for the use of the product beyond what is intended for the purpose of testing the nature, characteristics and performance of the product. You are responsible for the use of the product during the period of exercise of the right of withdrawal, which is not compatible with the principle of good faith, as well as for the reduction of the value, quality and safety of the product, in which case the refusal may be rejected, unless both parties agree otherwise.
   10. You are responsible for maintaining the quality and safety of the product during the period of exercise of the right of withdrawal.
   11. Except for the cases specified in clause 12 of these regulations, you can use the right of withdrawal and unilaterally withdraw from the contract within 14 days, covering:
   11.1. expenses for the delivery of the product, which is not the standard delivery method offered by SIA "NAIL infinity";
   11.2. the cost of returning the product, except for cases where SIA "NAIL infinity" has agreed to cover these costs or has not informed you that you have to cover the costs;
   11.3. decrease in the value of the product, if the product is used for a purpose other than to clarify the nature, properties and operation of the product, which is confirmed by expert expertise carried out by the seller of the product. You are not responsible for the decrease in the value of the product if SIA "NAIL infinity" has not informed you about the right of withdrawal in accordance with the procedures specified in the regulatory acts regulating the protection of consumer rights;

III. The consumer cannot exercise the right of withdrawal:

12. In the cases specified in Clause 22 of the Cabinet of Ministers Regulation No. 255 of May 20, 2014 "Regulations on distance contracts", including if:

the price of the product or service depends on financial market fluctuations that cannot be controlled by the seller and may occur during the right of withdrawal;

the goods are made to the consumer's instructions or are clearly personalized;

the product is perishable or soon to expire;

the consumer has opened the packaging of the product, which cannot be returned due to health and hygiene reasons;

the product, due to its characteristics, will irreversibly mix with other things after delivery;

13. The online store nailinfinity.eu does not store copies of the purchase contract.
14. SIA "NAIL infinity" website www.nailinfinity.eu has posted a form https://nailinfinity.eu/atteikumi/ to receive a refusal authorization number.
15. SIA "NAIL infinity" informs that upon ascertaining the loss of value of the returned goods, point 9, the seller has the right to withhold the loss of value of the goods or apply to the court with a claim application for covering the losses caused by SIA "NAIL infinity", which occurred as a result of the consumer's actions.
16. Please submit a complaint about the availability or quality of goods electronically to the following email address - info@nailinfinity.eu or submit an official complaint in writing to the following address: Riga, Brīvības iela 174a-8, LV-1012
    The complaint will be considered within 30 days from the day of receipt of the complaint, with a reply sent to the contact address specified in the complaint.

In the event that the submitted complaint is recognized as unfounded and you do not agree to the recognition of the complaint as unfounded, you have the right to use the alternative dispute resolution options provided for in the laws and regulations, by submitting a written application to the seller of the goods for out-of-court dispute resolution, stating:

1. Name, surname, contact information;
2. The date of submission of the application
3. The nature of the dispute, the claims and their justification.
