NAILINFINITY POLICY ON EXERCISING THE RIGHT OF WITHDRAWAL

1. GENERAL PROVISIONS

1.1. These NAILINFINITY Terms and Conditions Regarding the Exercise of the Right of Withdrawal (hereinafter referred to as the “Withdrawal Terms”) set forth the procedure by which the Consumer exercises the right of withdrawal provided for in applicable laws and regulations with respect to a distance contract, as well as conditions regarding the return of Goods, return shipping costs, reduction in the value of the Goods, refunds, and other matters related to the exercise of the right of withdrawal.

hereinafter referred to as the Seller or NAILINFINITY.

1.3. These Return Policy Terms apply to the online stores and domains managed by NAILINFINITY, including:

hereinafter collectively referred to as the “Website ” or “NAILINFINITY Websites.”

1.4. If, for a specific transaction on a NAILINFINITY domain, the Seller is a different legal entity, the terms and conditions published on that legal entity’s Website shall apply to the transaction in question.

1.5. These Cancellation Terms are an integral part of the NAILINFINITY Terms of Use and Distance Selling Terms with regard to the Consumer’s exercise of the right of cancellation.

1.6. The NAILINFINITY Delivery Terms also apply to matters related to delivery, receipt of shipments, and transportation.

1.7. In matters concerning product defects, non-conformity with the Agreement, commercial warranties, diagnostics, service, or repairs, the NAILINFINITY Warranty, Product Non-Conformity, Service, and Repair Terms and Conditions shall apply.

1.8. The terms “Consumer,” “Buyer,” “B2B Buyer,” “Product,” Order, Agreement, Delivery Service Provider, and other terms have the same meanings as in NAILINFINITY’s Terms of Use and Distance Selling Terms, unless otherwise specified in these Cancellation Terms.

1.9. If there is a conflict between these Cancellation Terms and NAILINFINITY’s Terms of Use and Distance Selling Terms regarding the right of cancellation, these Cancellation Terms shall apply as the special provisions in that specific matter.

1.10. NAILINFINITY provides the Consumer with the NAILINFINITY Withdrawal Form required by law, which the Consumer may download from the link provided in Section 6 of these Withdrawal Terms.

1.11. NAILINFINITY Use of the withdrawal form is not mandatory for the Consumer. The Consumer may also exercise the right of withdrawal by providing another unambiguous statement of their decision to withdraw from the Contract.

1.12. Nothing in these Cancellation Terms may limit the mandatory rights of the Consumer as set forth in applicable laws and regulations.


2. WHO HAS THE RIGHT TO REFUSE

2.1. The right to cancel the Contract within the time limits specified in the applicable laws and regulations is granted to the Consumer.

2.2. A consumer is a natural person who purchases a good or service for a purpose unrelated to their economic or professional activities.

2.3. The buyer’s status is determined based on the actual purpose of the specific transaction and the applicable laws and regulations, not solely on the information provided in the order or invoice.

2.4. For B2B buyers, the 14-day right of withdrawal provided for consumers in regulatory acts does not apply.

2.5. A B2B Buyer’s right to return Goods that comply with the terms of the Contract is governed by NAILINFINITY’s Terms of Use and Distance Selling Terms and, if applicable, by an individual agreement with the Seller.


3. 14-DAY RIGHT OF WITHDRAWAL

3.1. In the cases provided for by law, the consumer has the right to cancel a distance contract within 14 calendar days without giving a reason.

3.2. If a single Item is purchased, the withdrawal period begins on the day the Consumer or a third party designated by the Consumer (other than the carrier) takes possession of the Item.

3.3. If multiple Items are ordered in a single Order and are delivered separately, the withdrawal period begins on the date the last Item is received.

3.4. If a single Item is delivered in several batches or parts, the withdrawal period begins on the date of receipt of the last batch or part.

3.5. If the Contract provides for the regular delivery of Goods over a specified period, the withdrawal period is calculated from the date of receipt of the first Good.

3.6. In the case of a service contract, the cancellation period is calculated from the date the contract is concluded.


4. PICKING UP AN ORDER AT THE NAILINFINITY STORE

4.1. If a distance contract is concluded on the NAILINFINITY website, the fact that the Consumer subsequently receives the Product at a NAILINFINITY store does not, in and of itself, preclude the right of withdrawal applicable to the distance contract.

4.2. In such a case, the 14-day withdrawal period begins on the day the Consumer or a person designated by the Consumer actually receives the Goods.

4.3. If only a non-binding reservation for the Product is made on the Website, but the purchase Agreement is concluded at a physical store after the Buyer has inspected the Product and decided to purchase it, such a transaction is not, in and of itself, a distance contract, and the right of withdrawal provided for in a distance contract may not apply to it.


5. EXTENDED CANCELLATION PERIOD

5.1. If NAILINFINITY has not properly provided the Consumer with the information regarding the right of withdrawal required by law, the extended withdrawal period provided for by law shall apply.

5.2. If the relevant information has not been provided, the withdrawal period may be extended by 12 months following the expiration of the original withdrawal period.

5.3. If NAILINFINITY provides the required information during this additional period, the withdrawal period expires 14 days after the date on which the Consumer received the relevant information.


6. WITHDRAWAL FORM AND NOTICE OF WITHDRAWAL

6.1. To exercise the right of withdrawal, the Consumer must notify NAILINFINITY of their decision to withdraw from the Agreement before the withdrawal period expires.

6.2. NAILINFINITY provides the Consumer with the cancellation form required by law:

6.3. NAILINFINITY: The Consumer is not required to use the withdrawal form. The consumer may also exercise the right of withdrawal by means of any other unambiguous statement that clearly indicates the consumer’s decision to withdraw from the Contract.

6.4. A notice of withdrawal may be submitted by:

  • by sending the completed NAILINFINITY Cancellation Form to info@nailinfinity.eu;
  • by sending to info@nailinfinity.eu any other unambiguous written notice of the decision to withdraw from the Agreement;
  • by sending a written notice by mail to NAILINFINITY's address;
  • by submitting a written notice at a NAILINFINITY retail location;
  • by using another method of providing notice of withdrawal specifically offered by NAILINFINITY.

6.5. It is recommended that the following be included in the notice of withdrawal:

  • The consumer's first and last name;
  • The order or invoice number, if known;
  • The item or items to which the refusal applies;
  • The date of the order and/or receipt of the Goods;
  • contact information, if necessary to identify the Consumer or the Order.

6.6. Attaching a copy of the purchase receipt is not a mandatory prerequisite for exercising the right of withdrawal if the specific transaction can be identified in another way.

6.7. If the NAILINFINITY Withdrawal Form is submitted electronically, the Consumer’s physical signature is not required. The signature field provided on the form must be completed if the form is submitted in paper form.

6.8. The provision of an RMA number, a service request, prior authorization from the Seller, or the completion of any other additional procedures is not a prerequisite for the Consumer to exercise the right of withdrawal provided for in applicable laws and regulations.

6.9. The consumer is responsible for proving that the notice of withdrawal was sent within the specified time limit. Therefore, NAILINFINITY recommends saving the email delivery confirmation, postal receipt, or other proof of delivery of the notice.


7. CANCELLATION BEFORE RECEIVING THE ITEM

7.1. The consumer may notify NAILINFINITY of their decision to withdraw from the distance contract even before actually receiving the goods.

7.2. If the Order has not yet been handed over to the delivery service provider, NAILINFINITY will suspend its shipment to the extent possible.

7.3. If the shipment has already been handed over to the delivery service provider, NAILINFINITY and the Consumer shall agree on the most practical solution for returning the shipment.

7.4. An unambiguous notice of refusal by the consumer is not the same thing as simply failing to pick up a package.


8. FAILURE TO PICK UP A SHIPMENT DOES NOT CONSTITUTE NOTICE OF REFUSAL

8.1. Message:

  • failure to retrieve the package from the parcel locker;
  • failure to pick up from the pickup location;
  • Failure to pick up an order at the NAILINFINITY store;
  • failure to respond to the courier;
  • a simple refusal to accept an undamaged shipment without notifying the seller of the exercise of the right of withdrawal

in and of itself does not constitute a notice of refusal.

8.2. If the Consumer wishes to exercise the right of withdrawal, they must send NAILINFINITY an unambiguous notice.

8.3. If a shipment is returned to NAILINFINITY because the Buyer failed to pick it up and the Seller has not received a notice of refusal, NAILINFINITY’s Delivery Terms regarding unsuccessful delivery shall also apply.

8.4. Refusal to accept a shipment due to damage incurred during transit is considered valid if the cause of the damage is documented in accordance with NAILINFINITY’s Terms of Delivery; and is not equivalent to simply failing to pick up the shipment.


9. RETURNING GOODS

9.1. After sending the notice of withdrawal to the Consumer , the Product must be returned or shipped to NAILINFINITY without undue delay, but no later than 14 calendar days from the date on which the Consumer notified NAILINFINITY of their decision to withdraw from the Contract.

9.2. The deadline is considered met if the Item is shipped before the end of the 14-day period.

unless NAILINFINITY has specified a different return location in writing for that particular return.

9.4. You can:

  • send by mail or courier service;
  • deliver it in person to NAILINFINITY;
  • send in another format previously agreed upon with NAILINFINITY.

9.5. You do not need to send the product to the manufacturer, supplier, service provider, or any other third party, unless NAILINFINITY has specifically indicated otherwise.

9.6. Cash-on-delivery (COD) shipments may not be accepted without prior consent from NAILINFINITY.

9.7. NAILINFINITY recommends using a traceable shipping method and keeping proof of shipment for the items.


10. RETURN SHIPPING COSTS

10.1. If the Consumer exercises the right of withdrawal, the Consumer shall bear the direct costs of returning the Goods, provided that NAILINFINITY has duly informed the Consumer of this obligation prior to the conclusion of the Contract.

10.2. If, in a specific case, NAILINFINITY has agreed to cover the costs of returning the Goods, NAILINFINITY will bear those costs.

10.3. If the Consumer has not been properly informed of the obligation to cover the direct costs of returning the Goods, the consequences provided for in the applicable laws and regulations shall apply.

10.4. No separate fine or administrative fee shall be imposed on a consumer solely for exercising the right of withdrawal provided for in regulatory enactments.


11. OVERSIZED ITEMS AND ITEMS THAT CANNOT BE SHIPPED BY MAIL

11.1. If, due to the nature, weight, or size of the Product, it generally cannot be returned by mail, the Consumer shall be provided, prior to the conclusion of the Contract, with the information required by law regarding the direct costs of return or their estimated amount.

11.2. This may be particularly relevant, for example:

  • large-scale professional equipment;
  • sterilization equipment;
  • podiatry equipment;
  • large vacuum cleaners;
  • furniture;
  • heavy goods;
  • palletized shipments.

11.3. To arrange the return of such Goods, the Consumer is advised to contact NAILINFINITY before shipping them.


12. INSPECTION OF GOODS DURING THE CANCELLATION PERIOD

12.1. The consumer has the right to examine and inspect the Product to the extent necessary to determine its nature, characteristics, and functionality.

12.2. The inspection of the product must, in substance, correspond to the extent to which it would be possible to examine a similar product at a physical retail location.

12.3. Opening the package does not in and of itself result in the loss of the right of withdrawal, except in cases where an exception to the right of withdrawal, as provided for by law, applies to the specific Product.

12.4. During the withdrawal period, the consumer must handle the Product with care and avoid any actions that are not necessary to determine the nature, characteristics, and functioning of the Product.


13. PROFESSIONAL EQUIPMENT

13.1. The Consumer may reasonably inspect and functionally test the professional products sold by NAILINFINITY to the extent necessary to determine their nature, characteristics, and performance.

13.2. Depending on the specific Item, the amount required for inspection may exceed, for example:

  • performing a professional treatment on a client;
  • prolonged or repeated use of the Product;
  • the use of a dust extractor during an actual manicure, pedicure, or other procedure that generates dust or other debris;
  • prolonged or regular professional use of a router or hand tool;
  • the use of the sterilizer in actual repeated sterilization cycles;
  • Use of the product with abrasive materials, liquids, or chemicals;
  • the use of auxiliary materials or consumable components;
  • a significant increase in operating hours or cycles;
  • the creation of signs of use that would not occur during a normal inspection of the Goods or functional testing.

13.3. Turning on the Product briefly or performing a reasonable functional test does not in itself constitute a reduction in the Product's value.

13.4. Each case is evaluated on a case-by-case basis, taking into account the nature and characteristics of the specific Goods and the scope of inspection objectively required.


14. DECREASE IN THE VALUE OF GOODS

14.1. The consumer is liable for any decrease in the value of the Goods if the Goods have been used beyond what is necessary to ascertain their nature, characteristics, and functioning.

14.2. NAILINFINITY does not apply an automatic fixed percentage, restocking fee, administrative fee, or penalty simply because an item has been returned.

14.3. Impairment of an asset is assessed on a case-by-case basis and objectively, taking into account, for example:

  • frequency of use;
  • operating hours or cycles;
  • wear and tear;
  • pollution;
  • mechanical or cosmetic damage;
  • missing parts;
  • used or consumed supplies;
  • changes to the configuration;
  • The actual condition of the goods;
  • The objective market value and resale value of the goods.

14.4. NAILINFINITY may document the condition of returned items with photos or videos.

14.5. If a decrease in the value of the Goods is determined, NAILINFINITY will inform the Consumer of the circumstances and the basis for the decrease in value.

14.6. A write-down is applied only to the extent and in the manner permitted by applicable laws and regulations.

14.7. The Consumer is not liable for any decrease in the value of the Goods if NAILINFINITY has not properly provided the Consumer with the information regarding the right of withdrawal as required by law, to the extent that such laws and regulations so provide in the specific case.


15. ORIGINAL PACKAGING

15.1. The absence of the original packaging does not, in and of itself, automatically void the consumer’s right of withdrawal.

15.2. The consumer may open the product’s packaging to the extent objectively necessary to inspect and examine the product, provided that no exception provided for in applicable laws and regulations applies to the specific product.

15.3. NAILINFINITY recommends keeping:

  • original packaging;
  • internal protective materials;
  • instructions;
  • cables;
  • adapters;
  • accessories;
  • other components.

15.4. If the packaging is essential for the safe transport of the Goods or for their objective commercial value, and it has been significantly damaged or destroyed without good reason, this circumstance may be taken into account when assessing the reduction in the value of the Goods.


16. PRODUCT CONFIGURATION

16.1. When returning a Product, the Consumer must return all components included in the package with that Product, provided they are returnable.

This may include, for example:

  • the Product itself;
  • power supply unit;
  • cables;
  • handles;
  • tripods;
  • trays;
  • accessories;
  • reusable components;
  • documentation;
  • other components included in the set.

16.2. The absence of a component in a set does not in and of itself automatically void the right of withdrawal, but may result in an objective reduction in the value of the Product or the set.


17. REFUND

17.1. If the Consumer lawfully exercises the right of withdrawal, NAILINFINITY shall, without undue delay and no later than 14 days from the date NAILINFINITY receives the Consumer’s notice of withdrawal from the Contract, shall refund to the Consumer the amounts provided for by law.

17.2. In the event of a purchase, NAILINFINITY has the right to withhold a refund until:

  • to receive returned merchandise; or
  • As proof that the Consumer has returned the Item,

depending on which occurs first, unless otherwise provided by law in the specific case.

17.3. The refund shall be made using the same payment method that the Consumer used in the original transaction, unless the Consumer has expressly agreed to a different method of refund and such agreement does not result in additional costs to the Consumer.

17.4. The consumer is not charged a separate fee solely for processing the refund.


18. INITIAL SHIPPING COSTS

18.1. In the event of a complete cancellation of the Contract, NAILINFINITY will also refund the initial standard shipping costs to the extent provided for in applicable laws and regulations.

18.2. If the Consumer has chosen a delivery method that was more expensive than the least expensive standard delivery method offered by NAILINFINITY, NAILINFINITY is not obligated to reimburse the portion of the additional costs incurred due to the more expensive delivery method chosen by the Consumer.

18.3. In the event of a partial cancellation, the necessity and amount of a refund for the initial delivery costs shall be assessed in accordance with applicable laws and regulations and the specific circumstances of the Order.

18.4. NAILINFINITY does not automatically charge the Consumer a retroactive shipping fee simply because the remaining value of the Order, following a partial return of the Goods, has fallen below the free shipping threshold, unless another legally permissible condition was clearly specified for that particular offer prior to the conclusion of the Contract.


19. PARTIAL CANCELLATION OF AN ORDER

19.1. If multiple separate Items are purchased in a single Order, the Consumer may exercise the right of withdrawal only with respect to some of them.

19.2. If the Goods are sold as a single, indivisible set at a single price and the individual components of the set are not independently the subject matter of the Contract, the possibility of canceling only a specific part of the set shall be assessed in accordance with the structure of the specific offer and the Contract.


20. SPECIAL OFFERS, SETS, AND GIFTS

20.1. If, upon the purchase of a specific Item, the Consumer is given a gift free of charge under the clearly specified condition that the gift is provided only in conjunction with the relevant purchase, and the Consumer completely cancels that purchase, the gift must be returned along with the Product, provided that this condition was clearly communicated to the Consumer prior to the conclusion of the Contract.

20.2. If the Consumer partially cancels the Order and, following the cancellation, the previously clearly defined terms of the promotion or bundle are no longer met, the consequences shall be assessed in accordance with the terms of the specific promotion and applicable laws and regulations.

20.3. NAILINFINITY does not impose an automatic penalty for failure to return a gift or for exercising the right of withdrawal.

20.4. If a legally compensable loss of value or other claim objectively arises due to gifts that have not been returned, have been used, or have been damaged, NAILINFINITY will evaluate and justify each case individually.


21. HEALTH AND HYGIENE EXCEPTION

21.1. A consumer may not exercise the right of withdrawal with respect to a sealed Product if:

  1. The product was in sealed or tamper-evident packaging;
  2. The consumer opened this package after delivery; and
  3. For health or hygiene reasons, the product is objectively unsuitable for return once the packaging has been opened.

21.2. The fact that the Product falls under the category of cosmetics, manicure, pedicure, beauty care, hairdressing, podiatry, or any other professional beauty care category does not in itself mean that the right of withdrawal does not apply to the Product in question.

21.3. Exceptions to the hygiene policy are assessed based on the nature of the specific Product, its packaging, and whether, after the protective packaging has been opened, it is objectively possible to return the Product for health or hygiene reasons.

21.4. If an exception to the right of withdrawal applies to a specific Product, NAILINFINITY shall provide the Consumer with the relevant information prior to the conclusion of the Contract, in accordance with the procedures set forth in the applicable laws and regulations.


22. CUSTOMIZED AND MADE-TO-ORDER PRODUCTS

22.1. The right of withdrawal does not apply to Goods that have been manufactured according to the Consumer’s individual specifications or are clearly personalized.

22.2. The fact that fact that NAILINFINITY specifically orders a standard Product from a supplier or manufacturer based on the Consumer’s Order does not in and of itself mean that the Product is personalized or manufactured according to the Consumer’s individual instructions.

22.3. An item may be considered a custom-made or personalized item if its essential characteristics have been manufactured or significantly adapted specifically for that Consumer at the Consumer’s request.


23. OTHER EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

23.1. The right of withdrawal may not be exercised in other cases specified in regulatory acts either.

23.2. Depending on the specific product or service offered by NAILINFINITY, this may include, for example:

  • Goods that spoil quickly or are about to expire;
  • Goods that, due to their nature, have become irreversibly mixed with other items after delivery;
  • packages of computer software, audio, or video recordings that have been opened in cases specified by law;
  • provide the service in full, provided that the conditions for the loss of the right of withdrawal set forth in the applicable laws and regulations have been met;
  • urgent repair or maintenance services in certain cases;
  • digital content whose delivery has commenced in accordance with the requirements regarding consumer consent and information set forth in applicable laws and regulations;
  • other cases provided for in regulatory enactments.

23.3. If the right of withdrawal does not apply to a specific NAILINFINITY product or service, the Consumer is provided with the relevant information before the Contract is concluded.


24. SERVICES DURING THE CANCELLATION PERIOD

24.1. If a Consumer orders a paid service remotely and explicitly requests that the service begin before the end of the 14-day cancellation period, NAILINFINITY may begin performing the service in accordance with applicable laws and regulations.

24.2. If the Consumer exercises the right of withdrawal following such a request, the Consumer may be required, in cases provided for by law, to pay a reasonable amount for the portion of the service actually provided prior to receipt of the notice of withdrawal.

24.3. If the service has been fully performed with the Consumer’s prior explicit consent and the conditions set forth in applicable laws and regulations have been met, the Consumer may lose the right of withdrawal.


25. RIGHT OF WITHDRAWAL AND NON-CONFORMITY OF GOODS

25.1. The right of withdrawal and a claim regarding Goods that do not conform to the terms of the Agreement are two distinct legal remedies.

25.2. The consumer does not need to exercise the 14-day right of withdrawal to report a defect in the Goods or a failure to conform to the Contract.

25.3. If the Product is defective, does not function, or otherwise fails to comply with the terms of the Agreement, the Consumer may exercise the rights of claim provided for in applicable laws, regardless of whether the withdrawal period has expired.

25.4. In such cases , the NAILINFINITY Warranty, Product Nonconformity, Service, and Repair Terms and Conditions apply.

25.5. In the event of a justified claim regarding the nonconformity of the goods, the Consumer shall not be required to bear any costs that, in accordance with applicable laws and regulations, must be covered by the Seller.

25.6. Damage caused during transportation for which the Consumer is not responsible is not considered a reduction in the value of the Goods caused by the Consumer during the withdrawal period.

25.7. The procedures for reporting, documenting, and preserving evidence of damage incurred during transportation are further governed by the NAILINFINITY Terms of Delivery.


26. RETURN FROM A COUNTRY OUTSIDE THE CUSTOMS TERRITORY OF THE EUROPEAN UNION

26.1. If the Product is returned from a country or territory outside the customs territory of the European Union, the Consumer is advised to contact NAILINFINITY prior to shipment to obtain information regarding the necessary return and customs documents.

26.2. The documents accompanying the return shipment must contain accurate information regarding the nature of the shipment and the reason for its return.

26.3. The consumer must follow the lawful and reasonable instructions necessary to prevent the incurrence of unjustified import taxes, customs duties, or other costs by NAILINFINITY.

26.4. If direct and documented additional costs arise due to information knowingly provided incorrectly by the Consumer or due to the Consumer’s unjustified failure to cooperate, compensation for such costs may be assessed in accordance with applicable laws and regulations.


27. RETURN SHIPPING PACKAGING

27.1. Returned items must be packaged in such a way that they are adequately protected against damage during return shipping.

27.2. If the original shipping packaging has been retained and is suitable for reshipment, NAILINFINITY recommends using it.

27.3. Expensive, heavy, fragile, and professional equipment must be packed using shipping packaging and protective materials appropriate for its weight, size, and nature.

27.4. If the Product is damaged during return shipping due to improper packaging, this circumstance may be taken into account when assessing the decrease in the Product’s value caused by the Consumer.


28. PRODUCT IDENTIFICATION AND SERIAL NUMBERS

28.1. NAILINFINITY may inspect returned items:

  • serial number;
  • model number;
  • lot number;
  • another product identifier;
  • configuration.

28.2. Under the right of withdrawal, the Consumer must return the exact same Product that was received in that specific Order.

28.3. The return of other Goods, Goods belonging to other persons, Goods with an incorrect serial number, or Goods with a deliberately altered identifier shall not be considered a return of the Goods received in the specific Order.

28.4. In such a case, NAILINFINITY has the right to withhold the refund of the purchase price for the relevant Goods until the Goods received in connection with that specific Order have actually been returned, to the extent permitted by applicable laws and regulations.


29. INSPECTION OF RETURNED GOODS

29.1. Upon receiving the returned item, NAILINFINITY may inspect it:

  • Product identity;
  • configuration;
  • external condition;
  • visible signs of use;
  • pollution;
  • functional status;
  • operating hours or cycles, if the Product records such information;
  • serial numbers;
  • other objectively significant circumstances.

29.2. Such an inspection of the Goods within the scope of the right of withdrawal is not, in and of itself, a paid diagnostic service for the Consumer.

29.3. NAILINFINITY may take photos or record video to document the condition of the Goods at the time of receipt.


30. WORDING AND AMENDMENTS TO THE CANCELLATION PROVISIONS

30.1. The version of the Cancellation Provision that was in effect at the time the Agreement was entered into shall apply to that Agreement.

30.2. NAILINFINITY may amend these Cancellation Terms with respect to Agreements to be entered into in the future.

30.3. Subsequent amendments to these Cancellation Rules do not, in and of themselves, alter or reduce the consumer rights applicable to a Contract that has already been concluded.
