NAILINFINITY WARRANTY, PRODUCT NON-CONFORMITY, SERVICE, AND REPAIR TERMS AND CONDITIONS

1. GENERAL PROVISIONS

1.1. These NAILINFINITY Terms and Conditions Regarding Warranties, Product Nonconformities, Service, and Repairs (hereinafter referred to as the “Service Terms”) set forth the procedures for claims regarding product nonconformities, commercial warranties, diagnostics, service, maintenance, and repairs.

hereinafter referred to as the Seller or NAILINFINITY.

1.3. These Terms of Service apply to the online stores and domains managed by NAILINFINITY, including:

hereinafter collectively referred to as the “Website” or “NAILINFINITY Websites.”

1.4. These Service Terms are an integral part of the NAILINFINITY Terms of Use and Distance Selling Terms regarding issues related to nonconformity of goods, commercial warranties, diagnostics, service, and repairs.

1.5. In matters related to damage during delivery and transportation, the NAILINFINITY Delivery Terms also apply; in matters related to the right of withdrawal, the NAILINFINITY Terms Regarding the Exercise of the Right of Withdrawal apply.

1.6. Unless otherwise specified, the terms used in these Terms of Service have the same meanings as in the NAILINFINITY Terms of Use and Distance Selling Terms.

1.7. Nothing in these Terms of Service shall limit the Consumer’s rights that, under applicable laws and regulations, cannot be restricted by contract.


2. STATUTORY RIGHTS AND COMMERCIAL WARRANTY

2.1. A consumer's statutory right to make a claim and a commercial warranty are based on different legal grounds.

2.2. The consumer has the right to file a claim regarding the nonconformity of the Goods with the terms of the Contract within two years from the date of delivery of the Goods, provided that the claim is filed within two months from the date the nonconformity is discovered.

2.3. A commercial warranty, if granted for a specific Product, is an additional promise made by the warrantor and does not replace the Consumer’s statutory rights.

2.4. The term of the commercial warranty, the warrantor, the territory, and other conditions are specified in the warranty document for the specific Product, in the Product’s warranty and service information, or in another document provided to the Consumer.


3. FILING A CLAIM

3.1. If the Product appears to be non-conforming, the Buyer must contact NAILINFINITY:

3.2. In order for the claim to be evaluated, the Buyer is advised to provide the following:

  • The number of the order, invoice, or other document identifying the purchase;
  • Product name and model;
  • serial number, if any;
  • a description of the problem;
  • when and under what circumstances the problem was identified;
  • If possible, include a photo or video if it helps identify the problem.

3.3. The buyer is not required to determine the cause of the technical defect. The buyer must describe the problem identified and cooperate, to a reasonable extent, in its assessment.

3.4. A purchase can be verified not only with a paper receipt, but also with order details, an invoice, payment information, or other reliable proof of the transaction.


4. PRODUCT INSPECTION AND DIAGNOSTICS

4.1. The mere filing of a claim does not in itself mean that a manufacturing defect has been confirmed for the Product or that the Buyer is automatically entitled to a replacement Product or a refund of the purchase price.

4.2. NAILINFINITY has the right to inspect the Goods and, if necessary, perform technical diagnostics before making a decision.

4.3. The inspection may be performed by NAILINFINITY, the manufacturer, an authorized service center, or another qualified technical specialist.

4.4. NAILINFINITY may ask the Buyer to return the Product or the components necessary for evaluating the specific issue.

4.5. If a problem can only be evaluated in conjunction with another component of the Product—for example, the milling head control unit together with the handle—NAILINFINITY may request that both components be submitted.

4.6. The inspection required to assess a consumer’s legitimate claim regarding a nonconforming product is not, in and of itself, a paid diagnostic service.

4.7. If, during the inspection, the defect described by the Buyer is not found or cannot be reproduced, NAILINFINITY will inform the Buyer of the results of the inspection.


5. RESOLUTION OF PRODUCT NONCONFORMITIES

5.1. If it is determined that the Goods do not comply with the terms of the Agreement, the claim shall be resolved in accordance with the procedures and sequence set forth in the applicable laws and regulations.

5.2. Initially, the nonconformity is remedied by repairing or replacing the Product, taking into account the Consumer’s choice, the specific circumstances, and the reasonableness of the respective solution.

5.3. NAILINFINITY has the right to refuse the type of repair or replacement chosen by the Buyer, if it is not feasible or would entail disproportionate costs compared to another solution, in accordance with the criteria set forth in applicable laws and regulations.

5.4. In the event of a justified claim by the Consumer regarding a defect, repairs or replacement shall be performed free of charge, within a reasonable time, and without causing significant inconvenience to the Consumer.

5.5. The exchange of a Product for a new Product or a refund of the purchase price is not automatic simply because the Buyer requests it.

5.6. A price reduction or termination of the Contract and a refund of the purchase price shall apply only if the conditions set forth in the applicable laws and regulations have been met.

5.7. If it is possible to repair the item appropriately and reasonably, the mere fact that a defect exists does not automatically entail an obligation to refund the purchase price.


6. REPAIR AND EVALUATION TIMELINE

6.1. Repairs or replacements will be carried out within a reasonable timeframe, taking into account the nature of the Product, its technical complexity, and its intended use.

6.2. The actual completion time may be affected by:

  • the complexity of diagnosis;
  • availability of necessary replacement parts;
  • involvement of the manufacturer or an authorized service center;
  • Transportation of goods;
  • the necessary technical tests.

6.3. The deadline for providing a written response to a Consumer’s submission, as set forth in regulatory acts, shall not be considered a universal deadline for completing the repair of any technical Good.

6.4. A replacement product is not automatically provided during repairs unless such an obligation arises from applicable laws and regulations, a specific commercial warranty, or a separate agreement.


7. DAMAGES FOR WHICH NAILINFINITY IS NOT LIABLE

7.1. A claim regarding nonconformity of the Goods may be rejected in whole or in part if an inspection reveals that the reported issue arose after the delivery of the Goods and is causally related, for example, to:

  • drops, impacts, deformation, or other mechanical damage;
  • the ingress of liquids, dust, or foreign substances into the Product;
  • incorrect power supply, adapter, or connection;
  • Use of the product in a manner inconsistent with the manufacturer's mandatory instructions;
  • improper cleaning or maintenance;
  • the use of unsuitable accessories, parts, or supplies;
  • Improper repairs, disassembly, or modifications performed by the buyer or a third party;
  • another external factor that caused the specific damage.

7.2. The presence of external or mechanical damage does not, in and of itself, automatically void all of the Consumer’s rights. NAILINFINITY evaluates its liability in relation to the specific issue reported.

7.3. If the damage caused by the Buyer is found not to be related to the reported nonconformity, this in and of itself does not constitute grounds for rejecting a claim regarding another, unrelated nonconformity of the Goods.


8. NATURAL WEAR AND OPERATIONAL FACTORS

8.1. Normal wear and tear of the Goods that occurs during normal use and is not the result of an initial nonconformity of the Goods shall not be considered a nonconformity of the Goods with the terms of the Agreement.

8.2. Depending on the specific Product, it may wear out during use; for example:

  • filters;
  • gaskets;
  • bearings;
  • mechanical connections;
  • in engines for which they are intended;
  • rechargeable batteries and regular batteries;
  • other components subject to wear and tear.

8.3. The fact that a part is subject to wear and tear does not in itself mean that it cannot have a defect. Premature wear and tear or wear and tear that is inconsistent with the nature of the product is evaluated on a case-by-case basis.


9. USE, MAINTENANCE, AND UNAUTHORIZED INTERFERENCE

9.1. The buyer must follow the manufacturer's instructions for use, cleaning, maintenance, and safety applicable to the Product.

9.2. If failure to follow the mandatory instructions has caused the specific damage, the relevant claim may be denied to the extent that the damage is attributable to such conduct.

9.3. Failure to perform the recommended general preventive maintenance does not, in and of itself, automatically void the Consumer’s legal rights.

9.4. Prior to the evaluation of the claim, the Buyer is advised not to disassemble, modify, or repair the Product on their own or with the assistance of an unqualified third party.

9.5. If unauthorized or technically improper interference has caused damage or objectively prevents the cause from being determined, this circumstance may be taken into account when evaluating the claim.


10. PROFESSIONAL EQUIPMENT

10.1. During the technical evaluation of professional equipment, NAILINFINITY can examine all operating conditions and components of the Product related to the reported issue.

10.2. For nail drills, control units, and handles, the motor, bearings, connectors, cable, pedal, vibration, noise level, and other technically significant components can be inspected.

10.3. For vacuum cleaners, the condition of the filter, its installation, airflow, motor operation, ventilation pathways, and the conditions under which the product is used can be evaluated.

10.4. For UV/LED lamps, the following components can be inspected: diodes, sensors, power supply, control electronics, and other components. To evaluate the curing results, NAILINFINITY may also request information about the material used and how it was applied.

10.5. For sterilization and thermal equipment, the following can be evaluated: cycles, temperature, sensors, heating elements, error codes, maintenance history, and compliance with the manufacturer’s operating requirements.

10.6. A gradual decrease in battery life may be the result of normal wear and tear. Premature or unusual loss of performance is evaluated on a case-by-case basis.


11. CONDITION OF THE GOODS AND DELIVERY TO THE SERVICE CENTER

11.1. Items brought in for service must be reasonably clean and safe for technical handling.

11.2. Any item used in beauty, manicure, pedicure, or podiatry procedures must be cleaned of dust, product residue, and other significant contaminants before disposal, to the extent that this can be done safely and in accordance with the manufacturer’s instructions.

11.3. If the condition of the Goods poses an objective health or safety risk, the technical inspection may be postponed until the Goods can be handled safely.

11.4. If special professional cleaning or decontamination is required—beyond the routine measures necessary to remedy a nonconformity— a separate paid service will be provided only after prior agreement with the Buyer.


12. IDENTIFICATION OF GOODS AND RECORDING OF THEIR CONDITION

12.1. NAILINFINITY has the right to record and verify:

  • Product model;
  • serial number;
  • configuration;
  • visual condition;
  • visible damage;
  • The problem reported by the buyer;
  • service or diagnostic results.

12.2. NAILINFINITY may take photos or videos during the receipt and service process to document the condition of the Goods and the work performed.

12.3. In the event of a return, warranty claim, nonconformity, or service request, the same Item purchased in that specific transaction must be returned.

12.4. The submission of other Goods, Goods belonging to other persons, or Goods with an incorrect or intentionally altered identifier shall not be considered the delivery of the Goods for that specific Order to the service center.


13. PAID DIAGNOSTICS, SERVICE, AND REPAIRS

13.1. The paid service is separate from the Consumer's legal claim regarding the nonconformity of the Goods.

13.2. Paid services may include, for example:

  • post-warranty diagnostics;
  • preventive maintenance;
  • cleaning;
  • regulation;
  • replacement of worn-out parts;
  • repairs;
  • other works ordered by the Buyer.

13.3. Current prices are determined by NAILINFINITY Service and Repair Price List or Custom Quote.

13.4. If the exact repair cost can be determined only after diagnostics, NAILINFINITY will inform the Buyer of the repair cost or the estimated cost before beginning the paid repair.

13.5. Any significant additional work or components that increase the previously agreed-upon costs shall be performed only with the Buyer’s consent.

13.6. If the Buyer does not approve the repair estimate, NAILINFINITY will not perform the unapproved repairs.


14. SPARE PARTS

14.1. For repairs specific to the Product and in accordance with the agreed-upon repair plan, original, manufacturer-approved, or other technically suitable replacement parts may be used.

14.2. NAILINFINITY cannot guarantee the unlimited availability of replacement parts for all product models throughout their entire service life.

14.3. If the required part is not available, NAILINFINITY will notify the Buyer and, if possible, offer an alternative solution.

14.4. In the event of a legal nonconformity of the Goods, the consequences of the unavailability of replacement parts shall be resolved in accordance with applicable laws and regulations.


15. DATA AND SETTINGS

15.1. If it is possible to preserve the Buyer’s data, settings, or accounts on the Product, the Buyer must, before handing the Product over to the service center—if technically feasible—create a backup copy of the necessary data and remove any personal access credentials.

15.2. During the diagnostic or repair process, it may be necessary to reset the Product, update the software, or replace a component, which may result in the loss of settings or data.

15.3. NAILINFINITY does not back up the Buyer's data unless a separate agreement has been reached regarding such a service.


16. FAILURE TO PICK UP ITEMS AFTER SERVICE

16.1. When the Product is ready for pickup, NAILINFINITY notifies the Buyer using the contact information provided by the Buyer.

16.2. The buyer must pick up the item within a reasonable period of time after receiving the notice.

16.3. If the Product is not picked up, NAILINFINITY may grant the Buyer a reasonable extension of time.

16.4. A storage fee may be charged only if the Buyer has been informed in advance of the conditions for its application, the amount, or the method of calculation, and such a fee is legally permissible.


17. B2B BUYERS

17.1. B2B: The specific consumer protection rights intended for consumers do not apply to the Buyer, unless otherwise provided for in applicable laws and regulations or in the specific Contract.

17.2. The terms and conditions for B2B product warranties, nonconformities, diagnostics, and service are set forth in:

  • the specific Agreement;
  • the commercial warranty for the specific Product, if applicable to a B2B Buyer;
  • these Terms of Service;
  • the applicable provisions of the Civil Code and the Commercial Code.

17.3. If NAILINFINITY and the Buyer are businesses, the B2B Buyer is obligated to inspect the Goods as soon as possible after receipt and to immediately notify NAILINFINITY of any defects found, specifying the nature and extent of the defects.

17.4. The B2B Buyer must be notified immediately upon discovery of any hidden defects that could not be detected during the initial inspection.

17.5. If a B2B Buyer fails to comply with the applicable obligations regarding the inspection and notification of Goods, the consequences provided for in the Commercial Code may apply.

17.6. For B2B customers, diagnostics, transportation, repairs, and other services may be subject to a fee in accordance with the specific Agreement, commercial warranty, the NAILINFINITY Service and Repair Price List, or an individual estimate.

17.7. In B2B transactions, the Buyer does not have an automatic right to a new Product, a refund of the purchase price, a replacement Product, or a free diagnostic service, unless such rights arise from the specific Contract, an applicable commercial warranty, or applicable laws and regulations.


18. HANDLING OF COMPLAINTS

18.1. NAILINFINITY and the Buyer will first attempt to resolve any issues related to the Product or service through discussion.

18.2. A consumer’s written submission is reviewed, and a written response is provided within the time limit specified in the relevant laws and regulations.

18.3. If a physical inspection of the Goods, diagnostics, or additional information is required to assess the matter, the Buyer is obligated to cooperate to a reasonable extent and ensure that the Goods are available for inspection.

18.4. If the dispute cannot be resolved through negotiation, the Consumer may use the out-of-court dispute resolution mechanisms provided for in the applicable laws and regulations or bring the matter before a competent court.


19. REVISIONS AND AMENDMENTS TO THE TERMS OF SERVICE

19.1. With regard to issues of nonconformity of goods and commercial warranties, the version of the Service Terms that was in effect at the time the Contract was concluded shall apply to the specific purchase, to the extent that no rights mandatorily applicable to the Consumer are specified in laws and regulations.

19.2. For each individual paid diagnostic, maintenance, or repair service, the terms and conditions and price in effect at the time of ordering, or those agreed upon individually, shall apply.

19.3. NAILINFINITY may amend these Terms of Service with respect to future Agreements and services.

19.4. Subsequent amendments to the Terms of Service do not, in and of themselves, reduce the Consumer’s mandatory rights applicable to an Agreement that has already been concluded.
